Owner of Pornhub resolves sex trafficking probe with $1.8M payment to US government

Aylo Holdings, the parent company of Pornhub, has agreed to pay $1.8 million to the U.S. government to settle allegations of profiting from sex trafficking. The company, previously known as MindGeek, will be subject to a deferred prosecution agreement, which entails the appointment of a monitor to oversee Aylo and its compliance efforts for a period of three years.


Aylo and its affiliated adult content websites, including Pornhub, have faced criticism for their failure to adequately moderate third-party uploads of adult content. This lack of oversight has resulted in instances where victims of sex trafficking have been depicted in adult videos without their consent or knowledge, representing a serious violation of their rights.


The Eastern District of New York's Attorney's Office is currently investigating a network known as GirlsDoPorn (GDP) for their involvement in posting videos on Pornhub and other Aylo websites since 2009. In 2019, GDP was indicted by a federal grand jury in the Southern District of California on charges including sex trafficking. However, recent court documents filed by Aylo reveal that they profited from GDP's content. Authorities stated in a press release that Aylo should have been aware that they were hosting videos featuring women who were unaware they were being filmed or that their videos would be shared publicly.


The Attorney's Office in the Eastern District of New York is currently conducting an investigation into a network called GirlsDoPorn (GDP) for their involvement in the posting of videos on Pornhub and other Aylo websites since 2009. GDP was indicted by a federal grand jury in the Southern District of California in 2019 on charges related to sex trafficking. Recent court documents filed by Aylo reveal that they profited from GDP's content. Authorities have stated that Aylo should have been aware that they were hosting videos featuring women who were unknowingly filmed and whose videos would be shared publicly.


According to the release, many of these women had lodged complaints with Aylo between 2016 and 2019, asserting that the videos were posted without their consent. However, it was only several months after GDP was found guilty of sex trafficking that the network's videos were finally removed from Pornhub and other Aylo sites.


“This resolution will not only provide oversight over one of the largest online content distributors in the world and ensure the company’s lawful behavior, but it will also develop industry-wide standards for safety and compliance,” said U.S. Attorney Breon Pearce in a statement.


In the year 2020, Pornhub implemented several fresh additions to its platform, including the prohibition of video downloads and the mandatory verification of users for video posting. Additionally, the company enlisted the services of Kaplan Hecker & Fink LLP, a law firm, to conduct an impartial evaluation of its content compliance.


Over the past few years, Aylo, formerly known as Pornhub, has experienced a series of challenging events. The company underwent a change in ownership, being acquired by a newly established private equity firm called Ethical Capital Partners. Prior to this, both the CEO and COO of MindGeek, the parent company of Aylo, departed from their positions.


Earlier this week, three popular adult platforms, namely Pornhub, Stripchat, and XVideos, were included in the list of platforms that will be subjected to the most stringent regulations under the European Union's Digital Services Act (DSA). These regulations, which aim to enhance safety, include specific provisions for child protection. Once the EU's code of conduct for age-appropriate design is finalized, these platforms may be required to implement rigorous age verification measures. This would entail users having to provide official proof of their age and identity, rather than simply ticking a box claiming to be an adult.


In the United States, several states such as Louisiana, Mississippi, Virginia, and Utah have already implemented laws mandating age verification checks for adult websites. These checks are necessary for users to gain access to these platforms.


“Since [adding age verification], our traffic in Louisiana dropped approximately 80 percent,” Pornhub wrote in a statement. “Those people did not stop looking for porn. They just migrated to other corners of the internet that don’t verify age, that don’t follow the law, that don’t take user safety seriously, and that often don’t even moderate content.”


The proposal to require government ID for internet access has sparked a heated debate among privacy advocates and policymakers. While the intention behind this measure is to combat online harassment and protect vulnerable individuals, critics argue that it could lead to a dangerous erosion of privacy rights.


Requiring individuals to disclose their government ID to access the internet raises concerns about the potential misuse of personal information. With a vast amount of data breaches and hacking incidents in recent years, there is a legitimate fear that this sensitive information could fall into the wrong hands. Malicious actors could exploit this data for identity theft, surveillance, or other nefarious purposes.


Furthermore, the requirement of government ID for internet access undermines the principle of online anonymity. Anonymity has long been seen as a crucial aspect of the internet, allowing individuals to freely express their opinions, seek information, and engage in discussions without fear of retribution. By mandating identification, individuals may feel hesitant to voice their thoughts or engage in controversial discussions, stifling free speech and inhibiting the open exchange of ideas.


Lawmakers face a challenging task in finding a balance between protecting individuals online and preserving their privacy rights. While it is essential to address the issue of online harassment and protect vulnerable individuals, any proposed solution must carefully consider the potential consequences and ensure robust safeguards are in place to protect personal information. Striking the right balance will require a thoughtful and nuanced approach that respects both privacy and safety concerns.
