Justice Taiwo Olatokun of the Lagos State High Court in Ikeja has thrown out the lawsuit filed by Joseph Aloba, father of the late singer Mohbad.
The case aimed to overturn the legal opinion from the Directorate of Public Prosecutions (DPP), which found no grounds to prosecute music stars Naira Marley, Sam Larry, and others in connection with Mohbad’s death.
In his decision on Wednesday, Justice Olatokun affirmed that the Lagos State Attorney General, through the DPP, has the constitutional power to decide whether suspects should face prosecution. He stressed that this authority is beyond the reach of judicial interference in this matter.
The judge stated,
“Accordingly, the reliefs sought by the applicant lack merit and are hereby dismissed.”
Aloba, represented by lawyer Wahab Shittu, had argued that the DPP’s legal advice violated his right to a fair hearing and weakened the credibility of the coroner’s ongoing inquest.
The court dismissed these claims, ruling that the DPP’s advice was proper and based on the evidence before it.
It further clarified that the accused—including Naira Marley, Sam Larry, Prime Boy, and Babatunde Opere—were not acquitted but released due to a lack of sufficient evidence linking them to the case.
In a counter-affidavit dated June 24, 2025, Ayinde Ibrahim, a legal officer from the DPP, explained that the legal opinion was reached after a comprehensive review of the police investigation files.
He added,
“Neither the coroner nor the applicant had access to the full findings upon which the advice was based.”
“The legal advice found no conclusive evidence—whether direct or indirect—that implicated the suspects. Thus, the decision to discharge them was consistent with due legal process and the evidence.”
