Nollywood actress Kate Henshaw has called for the Nigerian government to establish stricter laws governing surrogacy, expressing concern over the growing risk of exploitation, especially of financially disadvantaged women.
Speaking during an interview with News Central, Henshaw emphasized the urgent need for a structured legal framework that would protect the rights, health, and emotional well-being of surrogates throughout the entire process.
She noted that surrogacy, while a legitimate avenue of hope for people struggling with infertility or medical complications, should not be treated casually or as a mere business transaction. “Surrogacy is a means to exploit people who are not financially capable.
You just pay them to have a child for you. But are you bound under any law to ensure they’re properly taken care of before and after childbirth?” she asked.
Henshaw questioned the absence of enforceable agreements and the lack of legal documentation in most surrogacy arrangements in Nigeria. She pointed out that the process involves not only physical changes but also deep emotional and mental impacts that many fail to consider.
She said, “It shouldn’t be something to be done lightly. There are lots of emotions attached to carrying a child… women can die, you know? So it shouldn’t just be thought of lightly.”
The veteran actress expressed hope that Nigeria will soon introduce concrete laws that go beyond suggestions, to ensure that surrogates are given the care and protection they deserve. “I hope Nigeria rises to meet this. I hope we have laws that work,” she added.
Her comments have sparked conversation online, as many Nigerians echo her sentiments on the need for stronger regulation in the fast-growing surrogacy space.
