Court Adjourns Speed Darlington’s N300M Rights Suit Against Police to March 19

The Federal High Court in Abuja has adjourned the N300 million fundamental rights enforcement suit filed by singer Darlington Achakpo, popularly known as Speed Darlington, against the Inspector-General of Police (IGP). Justice Musa Liman scheduled the case for March 19 to allow parties to adopt their processes.

The adjournment followed a notification by CSP Audu Garba, counsel for the police, that a further counter affidavit had just been filed in response to Speed Darlington’s affidavit. The singer’s counsel, Rosemary Hamza, stated that she had yet to receive the affidavit to prepare a response.

Case Background

Speed Darlington’s lawsuit, marked FHC/ABJ/CS/1832/2024, alleges that his arrest and detention violated his fundamental rights under the 1999 Constitution. He is seeking four court orders, including his unconditional release and N300 million in damages for unlawful detention.


The case stems from two separate arrests. The first occurred on October 4, 2024, for allegedly defaming fellow musician Burna Boy. Darlington claims he was detained for five days without being charged and subjected to inhumane treatment.


The second arrest took place on November 27, 2024, for allegedly jumping administrative bail. Darlington asserts he had notified authorities of a medical emergency and received permission to travel for a performance.


Police’s Position

In their counter affidavit, the police allege that Burna Boy filed a petition against Speed Darlington, citing threats and intimidation. They claim Darlington admitted to the allegations during the investigation.


Darlington, however, denies the police’s claims, describing them as false and misleading. He maintains he never admitted to any offense and insists his detention contravenes his constitutional rights.


Legal Developments

In a related matter, Justice Ekerete Akpan of another court in Abuja granted Speed Darlington bail on January 15. The singer was admitted to a N20 million bail with one surety after pleading not guilty to cybercrime-related charges.


The March 19 hearing will determine the next steps in the N300 million lawsuit.
