Bobrisky Files An Appeal Against Naira Abuse Sentence

Controversial figure Idris Okuneye, widely known as Bobrisky, has filed a notice of appeal challenging the six-month maximum sentence handed down to him by a Federal High Court in Lagos State.

Bobrisky was prosecuted by the Economic and Financial Crimes Commission (EFCC) on four counts related to the abuse of the Nigerian currency.

Having pleaded guilty before Justice A.O. Awogboro of the Federal High Court in Lagos, Bobrisky was sentenced to six months in prison without the option of a fine on April 12.

In response, Bobrisky's counsel, Mr. Bimbo Kusanu, filed a notice of appeal urging the Court of Appeal to overturn the maximum sentence. Instead, Kusanu proposed replacing the sentence with a N50,000 fine for each count.

Kusanu argued in the notice of appeal that the trial court had imposed the maximum sentence on Bobrisky, despite his lack of prior criminal convictions. He contended that the Administration of Criminal Justice Act provided for the imposition of a lesser sentence.

According to Kusanu, the trial court's sentence was punitive and contradicted the mandatory provisions of the ACJA. He claimed that the trial court failed to consider Bobrisky's positive history, noting that Bobrisky had promptly responded to the EFCC's invitation and had pleaded guilty without wasting the court's time.

Kusanu argued that the trial court's failure to exercise its discretion judiciously and judicially had led to a miscarriage of justice against Bobrisky.
