A Special Offences Court in Ikeja, Lagos, has adjourned until February 26 to rule on whether Justice Rahman Oshodi will recuse himself from the trial of former Central Bank of Nigeria (CBN) Governor Godwin Emefiele. The adjournment follows a request by Emefiele’s counsel, Senior Advocate of Nigeria (SAN) Olalekan Ojo, who accused the judge of bias. Emefiele’s co-defendant, Henry Omoile, represented by SAN Kazeem Gbadamosi, also made a similar request.
Emefiele is facing a 19-count charge of corruption and receiving gratification, while Omoile is accused of unlawfully accepting gifts. The case, prosecuted by the Economic and Financial Crimes Commission (EFCC), saw its lead counsel, Rotimi Oyedepo, conclude the testimony of Adetola John, Emefiele’s former personal assistant. John testified that he received $400,000 from a CBN director and delivered it to Emefiele.
During the proceedings, Oyedepo presented a WhatsApp message from Eric Odoh, another aide, as evidence. The defence objected, arguing the document was not formally admitted as evidence. However, Justice Oshodi overruled the objection, citing Section 224 of the Evidence Act, which allows leading questions on undisputed matters.
Dissatisfied, Emefiele’s counsel accused the judge of bias, claiming the ruling prejudged the case and hindered fair cross-examination. They requested Justice Oshodi to recuse himself. The EFCC opposed the application, calling it a delay tactic and urging the court to proceed with the trial.
Justice Oshodi adjourned to rule on the recusal request and another application by Emefiele’s team to appeal the court’s earlier decision assuming jurisdiction. The case continues to draw significant attention as it unfolds.
