Brazilian model criticizes 'unequal treatment' as she potentially faces imprisonment for walking her dog without a shirt(Photo)

 


A Brazilian bikini model, Caroline Werner, is questioning the fairness of her potential one-year jail sentence for going topless near a beach. 


She argues that Brazil's constitution guarantees gender equality, yet there are double standards that allow men to be shirtless in public without facing legal consequences. 


Werner criticizes Brazil's patriarchal and violent culture, highlighting the inconsistency in prosecuting women for the same offense that men get away with.


She alleged this, after being apprehended by the Police Authorities while taking her dog for a walk in Balneário Camboriú.


The businesswoman, who is the proud owner of her own bikini brand, claims to have been subjected to police brutality and unjustly confined to a prison cell.


'Unfortunately, in my country even though the Constitution ensures gender equality, in practice this does not happen,' Werner told Brazilian news outlet G1.

 

'What should be normal for both genders ends up being denied to one of them in an arbitrary and repressive manner.'



In May of this year, Werner was issued a summons for engaging in an alleged "obscene act" when she took off her shirt at a beach and wrapped it around her waist before walking her dogs.


The charge, as stated in Article 233 of the Penal Code, refers to the act of performing something indecent in a public place, whether it is open or accessible to the public.


It is worth noting that the law does not provide a clear definition of what constitutes an "obscene act."


'When crossing the street to leave the dogs, I was approached by the Municipal Guard in a completely arbitrary and disproportionate way,' Werner said. 'They arrived already putting my hands behind me and handcuffing me.'


Werner was given a blouse by the police to cover her breasts and was then escorted to a police station. However, she was left handcuffed against metal bars in a jail cell that lacked proper lighting. 


She claimed that her rights to due process were violated as the police did not permit her to make a phone call to her family or a lawyer.


'I spent more than an hour in that situation, unable to speak to anyone and, even though I had asked for I was denied my right to speak to my lawyer several times,' Werner added.
