Yoruba Nation agitator Sunday Igboho’s case against the DSS took another dimension on Tuesday. Just as Igboho thought he had won, the Court of Appeal, Oyo State, thought otherwise.
Justice Muslim Hassan of the Ibadan Division of the Court of Appeal, Oyo State, set aside the N20 billion exemplary and aggravated damages awarded to Yoruba Nation agitator Sunday Igboho against the Department of State Security.
The court also nullified the judgment that declared the attack on Igboho’s house illegal, describing the award for damages against the DSS as outrageous.
The judge, Justice Hassan, while deciding his ruling, criticized the state high court’s initial ruling. He said that the Oyo State High Court did not consider the grounds for the case in getting jurisdiction. He added that the judge should not have decided on the award of damages based on his preferences.
